Introduction

To ensure that health and safety are provided in a corporation, it is essential to prevent work-related injuries and illnesses. This can be achieved by providing health and protection training for the staff, which should be free of cost. J. Sainsbury, a retail shop is the best candidate for this assignment. The assignment focuses on four main points. The central theme of this assignment is to provide a clear understanding of the legal prerequisites, as well as suggestions to make sure of the health, protection, and safety of the business. The second part describes the fundamentals required for a healthy and safe area for a job, which is related to the physical factors and the equipment used by J. Sainsbury. The third part is about the jobs and responsibilities to ensure health and safety for those people who are conducting the project at J. Sainsbury. Lastly, the fourth point features the risk factors associated with J. Sainsbury’s administrative work environment.

P1 Explain the legal requirements and regulations for ensuring the health, safety, and security of those employed in the business

I was appointed as an assistant for health and safety in J. Sainsbury. The operational manager of the shop asked me to conduct a meeting regarding health and safety, this meeting described details about the health-related regulations and the impact they could have on the commercial enterprise. Over the years, J. Sainsbury has systematically carried out the health and protection policies, however, employees are provided with greater rights and responsibilities. Employers are legally obligated in making sure that the policies about health and safety are followed effectively in the enterprise.

Legal procedures are used to maintain the security of the employees in their workplace, as well as the protection of their rights. Employers are legally responsible for providing protection and health in their administrative centers (Stranks, 2015). The workforce nowadays has more rights and duties in their favor. This is because more laws have been made for their benefit in making sure that they are safe in the operational department.

One of the duties of the employer is to provide a safe workplace for their people. They should arrange a suitable workforce who are solely responsible for carrying equipment such as tables, chairs, and other such essentials. This is because instructors are not legally accountable for carrying these, otherwise, they will suffer from physical injury. Their job is to provide information, methods, and supervision related to health and safety. Also, the employees’ duty is to take good care of their health and be cautious at all times. Otherwise, legal action would be taken against them by others who are affected by their actions.

The Management of Health and Safety at Work Regulations 1974

Health and Safety Executive Act (2017) law’s objective is to help in reducing the damage of the personnel present inside the operational branch. This is done by evaluating the risks and making plans for potential emergencies that can happen within the enterprise. There are many dangers which are associated with the operational department, this is because the equipment used is heavy, highly complex, and expensive. So accurate measures must be taken in order to handle them. J. Sainsbury thoroughly follows this act, by supervising that laborers who are appointed for this task, have the required training and expertise. The operational branch always manages threat assessments after an accident, because this activity falls under the Management of Health and Safety at Work Regulations. J. Sainsbury hires expert technicians who have the ability to handle specific chemical substances in a protective manner. The operational workforce is needed to give risk assessment exams at any given time.

Health and Safety at Work Act 1974

This is notable information on legal procedures, where the act allows different sets of rules to be passed, provided that the rules would not be able to exchange the act itself (Ridley, 2016).  It includes 5 vital acts, which help to protect people in their job, provide defense for those who were absent from their workplace. Also, it provides strict control over the transportation, handling, and storage of all explosives. These legal procedures help to keep the enterprise up to date regarding their safety techniques. The rule states that if there are more than five people present inside an organization, this also includes the operational unit.

Then J. Sainsbury has to submit a written statement about health and safety. However, the Health and Safety Act (2008), increased the power of the law by confirming that the employees who did not follow the 1974 Act, would suffer severe consequences. In the long run, this was helpful, because it will make the staff dutifully follow the 1974 Act. In J. Sainsbury, it is mandatory for the workforce to take care of their health and safety.

The Workplace (Health, Safety, and Welfare) Regulations 1992

The act is applicable for all enterprises, except for transport and building sites which are away from the head office of the enterprise, these are usually caves, mines, tunnels, forest industries (Ridley, 2016).  This set of rules and regulations are important for those who are in charge of the business or in other words self-employed. The key aspect of this rule is to keep to the basics of welfare intact. This act is separated into 2 areas: The environment of the working place and its facilities. The doors and windows of J. Sainsbury are cleaned meticulously on a regular basis, this is to keep records that the act is being followed. Hygiene and cleanliness are quite vital also. Sanitizers in the operational department are kept in proper storage and are sterilized in order for the staff to apply.

The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995

Over 1.6 million injuries occur to humans each year when they are involved with painting on buildings. As a result, two hundred humans die every twelve months. Therefore this act makes sure that workers from different levels report diseases, incidents, or any such harmful occurrences which fall under the operational branch, and these clauses are all included in the act (Stranks, 2015). Usage of hand sanitizers, soaps, or any other hygiene practices is a must in J. Sainsbury. This provides protection from illness or any harmful microorganisms such as bacteria. These are then kept as records, which are then inspected by the Riddor authority to analyze them in detail.

The personnel from the operational management present the details to the Riddor authority, this includes lists of injuries, the demise of individual personnel, and work-related illness. It also provides a record of whether an employee was absent from his/her work for 3 consecutive days.  There is an on-web page scientific room which is provided by J. Sainsbury. This web page comprises of latest resource package and vital equipment which are very much needed when there is a risk of potential damage or infection. But if the circumstances are grave, then the accurate chance assessment would be immediately performed and are sent to clinics or any other healthcare center.

The Control of Substances Hazardous to Health Regulations 1994

The operational management is made up of large sections of various materials that are used to manufacture products. This act is usually known as the COSHH act, which was altered in 1999. In the operational department, there are many methods that can expose employees to harmful chemicals and other such substances. Therefore, this act has been modified into installed equipment, which can be used, transported, and stored in a precise manner. J. Sainsbury taught their personnel to be well-informed about the techniques and methods of handling substances. J. Sainsbury also has professional technicians who measure the materials, place the utmost care in them, and later on safely transport them into their desired locations so that nobody would be at risk.

P2 Describe the requirements for a healthy and safe workplace, as applied to the physical environment and equipment used in J. Sainsbury.

  1. Sainsbury must ensure that their workplace is safe and secure for their workers to conduct their activities inside the operational unit. If they want to obtain a secure environment, they must follow a series of rules and regulations.

 Physical Environment and Equipment

All the employers should put the utmost priority in the physical environment of their enterprise. This will build healthy and safe working conditions, as a result, workers would feel protected and have a sense of belonging in their workplace. This responsibility is fulfilled by the employers. Although an enterprise can be surrounded by hazards and risks, these difficulties could be overcome if both the employer and employee work together in a united manner. Accidents can occur due to falling objects, hand tools, or moving objects. But it is the employer’s responsibility to perform risk evaluation every now and then.
